These Terms and Conditions (“Terms”) govern your access to and use of the GetBooked software platform (“GetBooked”, “we”, “us”, “our”). By creating an account or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the GetBooked platform.

  1. 1. About GetBooked

GetBooked is a software-as-a-service (SaaS) platform that provides tools for businesses to manage equipment rentals, inventory, bookings, payments, documents, and related operations.

GetBooked does not own, rent, supply, or manage rental equipment and is not a marketplace or broker between customers and renters. All rental transactions are conducted solely between you and your customers.

  1. 2. Eligibility & Account Registration

You must be at least 18 years old and legally capable of entering into a binding contract to use GetBooked.

You are responsible for:

  • Providing accurate and complete account information
  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account

You must notify us immediately of any unauthorised access or security breach.

  1. 3. Subscription Plans & Fees

Access to GetBooked is provided on a subscription basis under the pricing plans displayed on our website.

3.1 Billing

  • Subscriptions are billed monthly or annually, depending on your selected plan
  • Fees are payable in advance
  • All prices exclude VAT unless stated otherwise

3.2 Non-Payment

If payment is not received:

  • We may suspend or restrict access to the platform
  • Continued non-payment may result in account termination

3.3 Refunds

Unless required by law, subscription fees are non-refundable. No refunds are provided for partial billing periods or unused time.

  1. 4. Licence to Use the Software

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use GetBooked during your active subscription, solely for your internal business operations.

You must not:

  • Copy, modify, reverse-engineer, decompile, or attempt to extract source code
  • Resell, sublicense, or commercially exploit the platform
  • Use the platform in a way that interferes with its security or performance

All intellectual property rights remain the exclusive property of GetBooked.

  1. 5. Acceptable Use

You agree not to use GetBooked to:

  • Violate any applicable laws or regulations
  • Store or transmit unlawful, harmful, or misleading content
  • Infringe intellectual property or privacy rights
  • Attempt unauthorised access, data scraping, or system abuse

We reserve the right to suspend or terminate accounts that breach this section.

  1. 6. Customer Data & Data Protection

You retain ownership of all data you upload to GetBooked (“Customer Data”).

We process Customer Data in accordance with:

  • Our Privacy Policy
  • Applicable UK GDPR and data protection laws

You are responsible for:

  • Ensuring you have lawful rights to collect and process customer data
  • Maintaining compliance with data protection laws in your business

On termination, you may request export of your data within a reasonable timeframe.

  1. 7. Third-Party Services

GetBooked integrates with third-party services (e.g. payment providers, messaging tools).

We are not responsible for:

  • Availability or performance of third-party services
  • Data handling by third-party providers

Use of third-party services is subject to their own terms and policies.

  1. 8. Service Availability & Support

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Planned maintenance, updates, or unforeseen outages may occur.

Support is provided according to your subscription plan and communicated support channels.

  1. 9. Termination

9.1 By You

You may cancel your subscription at any time via your account settings. Access will continue until the end of your billing period.

9.2 By Us

We may suspend or terminate your account if:

  • You breach these Terms
  • Payment obligations are not met
  • Use of the platform poses security or legal risks

Upon termination, access to the platform will cease.

  1. 10. Limitation of Liability

To the maximum extent permitted by law:

  • GetBooked is provided “as is” and “as available”
  • We are not liable for indirect, incidental, or consequential losses
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim

Nothing in these Terms limits liability for death, personal injury, fraud, or matters that cannot legally be excluded.

  1. 11. Indemnity

You agree to indemnify and hold GetBooked harmless from claims, losses, or damages arising from:

  • Your misuse of the platform
  • Your rental operations or customer disputes
  • Breach of these Terms or applicable laws
  1. 12. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on our website with a revised “Last updated” date.

Continued use of GetBooked after changes constitutes acceptance.

  1. 13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
